The city said yes. The zoning is clean. The permit is available. And the deal still dies — because the HOA said no. Private restrictions kill more STR deals than public ones, and they are easier to miss.
Where the killer language hides
- CC&Rs. Look for "residential use only," "no business or commercial activity," and anything defining "single-family use." Courts in many states have read these clauses to prohibit STRs even without the word "rental."
- Minimum lease terms. A 30-day, 6-month, or 12-month minimum lease provision is an outright STR ban wearing a polite disguise.
- Rental caps. Some HOAs cap the percentage of homes that may be rented at all. If the cap is full, your client waits in line — possibly for years.
- "No transient use" clauses. This phrase is written specifically to stop STRs. It is fatal.
- Condo bylaws and house rules. Condos add board-approval requirements, guest registration rules, and amendment histories. A building that allows STRs today can amend its bylaws next year — check whether an amendment is under discussion.
How to actually verify
Not by asking the listing agent. "I think rentals are fine" is not due diligence, and the listing agent has every incentive to be optimistic. Instead:
- Order the full resale package: CC&Rs, bylaws, rules, recent amendments, and meeting minutes.
- Read the minutes from the last 12 months — STR complaints and pending rule changes show up there first.
- Get the management company's answer in writing: "Are short-term rentals under 30 days currently permitted at this address?"
- Make the offer contingent on HOA document review — more on that in Lesson 11.
