Florida State Preemption — and the 2011 grandfather clause

Florida is a partial preemption state, and the detail decides everything.

Fla. Stat. § 509.032(7)(b) bars local governments from adopting new ordinances that prohibit vacation rentals, or that regulate their duration or frequency of rental, or that regulate them based solely on their classification, use or occupancy.

The grandfather clause is the whole game. That preemption does not apply to any local ordinance adopted on or before 1 June 2011. Pre-2011 ordinances remain fully enforceable no matter how restrictive — including ones that cap how many times a year you may rent. Two Florida cities can therefore sit under opposite regimes, and the deciding factor is a date, not a policy. Always establish whether the governing ordinance predates June 2011.

  • Noise, nuisance and parking enforcement not based solely on rental classification.

State licensing. Under Fla. Stat. § 509.241, anyone operating a transient public lodging establishment — a unit rented more than three times a year for periods under 30 days, or advertised as regularly available for such stays — must hold a Florida DBPR vacation rental licence before operating. State sales tax plus the county Tourist Development Tax apply on top.

2026 status: SB 280 (2024), which would have centralised vacation rental regulation under DBPR, was vetoed by the Governor in June 2024, and no equivalent preemption-expansion bill has since passed. The 2011 framework above remains the operative law.

Jacksonville Beach Rules

Jacksonville Beach regulates short-term rentals under Ordinance 2019-8118. Adopted in 2019, it post-dates the 2011 cutoff, so the city cannot restrict how often or how long you rent — but it runs a genuine certificate and inspection regime.

The stack of registrations you need:

  • City Short-Term Vacation Rental Certificate$150 per property, initial and annual.
  • City Local Business Tax Receipt$79.20 per year per property.
  • Duval County business tax receipt.
  • Florida DOR sales tax certificate of registration.
  • Florida DBPR vacation rental licence.
  • Duval County Tourist Tax certificate.

Inspection. A Fire Marshal inspection is required before the initial certificate is issued, and again after modifications. A $100 no-show fee applies if access is not provided for a scheduled inspection.

Occupancy: two persons per bedroom plus two additional occupants, to a maximum of 16 per unit — notably generous compared with nearby St. Johns County's cap of 10, and a genuine advantage for larger properties.

Zoning: short-term rentals are permitted in every zoning district where residential use is allowed. The city does not zone them out of residential areas — though private HOA, condo and deed restrictions still can, on any individual property.

Renewals are due by 1 October. Owner-occupied units renting half or less of the unit are reported to be exempt from the full regime. We could not confirm the penalty schedule, any minimum-stay rule, or whether a certificate transfers on sale against the primary ordinance text — assume it does not transfer and confirm with the city before closing.

Buyer Due Diligence Checklist
